Terms and Conditions
Robixx Corp. is a California corporation, hereafter referred to as "Robixx". "DoNotCallDNC"
is a DNC (do-not-call) list scrubbing service operated by Robixx, subject to the terms
and conditions herein. The term "USER" shall include free and paying customers for
the purposes of this agreement. USER warrants that it is the end-user of the service
provided by DoNotCallDNC and will abide by the terms and conditions set forth herein.
Reliability of Data and Service
Robixx makes no warranty, expressed or implied, as to the reliability or accuracy
of either its service or data provided. USER acknowledges that all data received
and service rendered from DoNotCallDNC is in "AS IS" condition and shall be used at the sole risk of
the USER.
USER agrees and acknowledges that it shall have no legal or financial recourse against
Robixx, its officers, directors, employees or data-providers for defective, missing,
incomplete or otherwise inaccurate data and service.
Outages may occur in DoNotCallDNC from time to time for a variety of reasons including
but not limited to system maintenance, system crashes, and power outages. USER acknowledges
that such service outages may occur and agrees that it shall have no legal or financial
recourse against Robixx, its officers, directors, data-providers or the web hosting
firm as a result.
Indemnification
USER hereby agrees to hold harmless and indemnify Robixx, its officers, directors,
employees and all third-party data providers to DoNotCallDNC from and against any
and all direct and indirect claims, costs, losses, demands, proposed litigation
and actual litigation arising out in using DoNotCallDNC as well as by any third-parties
associated with the USER including but not limited to it's clients, employees, and
subjects of investigation.
Further, USER agrees to pay all attorney and legal fees incurred by Robixx, its
officers, directors, employees and third-party data providers in defense of any
claims brought by the USER as well as any third parties associated with the USER
including but not limited to it's clients, employees, and subjects investigation,
regardless of whether or not DoNotCallDNC’s data was defective and contributed to
such misidentification.
Governing Law
The validity, interpretation, construction and performance of this agreement, and
all acts and transactions pursuant hereto and the rights and obligations of the
parties hereto shall be governed, construed and interpreted in accordance with the
laws of the state of California, without giving effect to principles of conflicts
of law.
Privacy of User Data
All account information provided by USER to DoNotCallDNC shall be treated with confidentiality.
Data such as IP address and other usage data, will be captured and logged and
at Robixx sole discretion will be use for analytical purposes for the improvement of its
user's experience and to detect any abuse or fraud.
